DECRETO Nº 11.034, DE 5 DE ABRIL DE 2022
O que diz a Lei
Decreto regulamenta a Lei nº 8.078, de 11 de setembro de 1990 – CDC, para estabelecer diretrizes e normas sobre o SAC, com vistas a garantir o direito do consumidor.
A inclusão do direito a proteção e privacidade de dados mesmo sendo um direito constitucional, é abordado no Art. 9º – “Os dados pessoais do consumidor serão coletados, armazenados, tratados, transferidos e utilizados exclusivamente nos termos do disposto na Lei nº 13.709, de 14 de agosto de 2018.”
Nas disposições finais descreve
Art. 16. A inobservância ao disposto neste Decreto acarretará a aplicação das sanções estabelecidas no art. 56 da Lei nº 8.078, de 1990 – Código de Defesa do Consumidor, sem prejuízo da aplicação das sanções constantes dos regulamentos específicos dos órgãos e das entidades reguladoras.
Ou seja, ele poderá ser enquadrado tanto no CDC e na LGPD, definitivamente acabando com a máxima de que a LGPD é um CDC.
Art. 18. Este Decreto entra em vigor cento e oitenta dias após a data de sua publicação.
Dia 05 de Outubro de 2022, já vai estar valendo.
